Custominder Acceptable Use Policy
Rules governing lawful use, account security, prohibited conduct, Customer content, automated activity, and enforcement.
1. Scope and Relationship to the Terms
This Acceptable Use Policy (AUP) applies to Customers, Authorized Users, and anyone accessing Custominder through a Customer account, integration, or automation. Custominder is operated by Lotusware Inc. (Lotusware). This policy supplements the Custominder Terms of Service. Where provisions conflict, the Terms of Service control to the extent permitted by law.
2. Lawful and Authorized Use
Use Custominder only for lawful business activities and within the permissions granted to your account, Subscription, and applicable law. Customers are responsible for their business activities and Authorized Users acting on their behalf. Do not misrepresent your identity, authority, or affiliation.
3. Illegal Activity and Harmful Content
Do not use the Services to commit or facilitate fraud, unlawful transactions, threats, harassment, infringement of intellectual property or privacy rights, or distribution of unlawful content. Do not transmit unlawful spam, phishing messages, deceptive requests, or malicious files. Customers remain responsible for the legality of their own messages, documents, events, invoices, decisions, and transactions.
4. Security and Access
Do not attempt unauthorized access to accounts, systems, data, or networks; steal credentials; introduce malware; exploit vulnerabilities; or bypass authentication, access permissions, or security controls. Protect credentials and promptly report suspected account compromise or serious security vulnerabilities through Custominder support. Security testing requires prior written authorization.
5. Platform Availability and Fair Use
Do not intentionally degrade platform performance, deny service to others, abuse shared infrastructure, overwhelm APIs, or evade technical safeguards, Subscription limits, or licensing conditions. Automation and connected integrations must operate within authorized access and applicable limits and must not materially disrupt other Customers.
6. Customer Content, Communications, and Third Parties
Customers determine and are responsible for Customer Content and their own business activities. Obtain required rights and consents before uploading, sharing, or processing information about others. Do not use communications, contact lists, events, member portals, voting, or billing features to mislead recipients or violate law. Lotusware is a technology provider, not automatically a party to Customer agreements.
7. Artificial Intelligence and Integrations
Where AI-assisted functions or external integrations are available, use them lawfully and within granted permissions. Review AI-generated content before relying on it for decisions or publishing it; do not use such features to bypass security, violate others’ rights, or submit unlawfully obtained data. AI output may be inaccurate. AI processing and any model-training restrictions remain governed by the Terms and Privacy Policy.
8. Reports and Non-Urgent Violations
You may report suspected misuse through Custominder support with relevant details. For a violation that does not present an immediate legal, security, or operational threat, Lotusware will ordinarily notify the Customer and allow a reasonable opportunity to correct it. Continued violations may lead to proportionate access restrictions or suspension, consistent with law.
9. Immediate Threats and Unlawful Conduct
Where activity presents an immediate threat to security, other Customers, Services, or platform stability, Lotusware may immediately restrict affected accounts, features, or integrations without advance notice where lawful. If unlawful activity is established on a sufficiently reliable basis, Lotusware may suspend or terminate affected access and preserve evidence or cooperate with lawful authorities where required or permitted.
10. Consequences, Data, and Legal Rights
Restrictions may limit access to Customer Data or exports while legal or security measures apply. Where feasible and lawful, Lotusware may offer a safe path to access or export. Suspension or termination for established unlawful activity or a material Customer breach does not create a refund right except as law requires; unpaid future Subscription periods will not be charged solely because access was terminated. Customer Data ownership does not transfer to Lotusware. Applicable legal rights and the liability and indemnity terms of the Terms of Service remain in force.
11. Policy Updates and Contact
Lotusware may update this policy in accordance with the Terms of Service and applicable law. The published version will identify its effective date. Contact Lotusware through the Custominder website Contact Us page or, for registered users, the application support channel.
